Terms & Conditions

These terms and conditions apply to all work carried out by Oswald Decorating (referred to throughout as "we", "us", or "David Stewart") and form the basis of the agreement between Oswald Decorating and the client (referred to as "you" or "the client").

By accepting a quote or instructing us to carry out work, you agree to these terms and conditions.

  1. QUOTATIONS

All quotations provided by Oswald Decorating are free of charge and carry no obligation. Quotations are valid for 30 days from the date of issue unless otherwise stated. Quotations are based on the information provided at the time of visit. Should the scope of work change, a revised quotation will be provided before any additional work is carried out. We reserve the right to amend a quotation if the condition of the property or scope of work differs materially from what was agreed.

  1. ACCEPTANCE OF WORK

Acceptance of a quotation, whether verbally, in writing, or by payment of a deposit, constitutes agreement to these terms and conditions. Work will be scheduled once acceptance has been confirmed and any required deposit has been received.

  1. DEPOSITS & PAYMENT

For larger projects, a deposit may be required prior to work commencing. The deposit amount will be confirmed at the time of quotation. The remaining balance is due upon completion of the work unless otherwise agreed in writing. Payment is accepted by bank transfer, cash, or other methods agreed in advance. Invoices are due for payment within 14 days of the date of issue unless otherwise stated. We reserve the right to charge interest on overdue invoices in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

  1. MATERIALS & PREPARATION

Unless otherwise agreed, the client is responsible for moving furniture and personal belongings prior to work commencing. Oswald Decorating will take reasonable care to protect flooring, fixtures, and fittings during the course of work. We are not liable for any damage caused by pre-existing conditions, structural faults, or materials supplied by the client. Where materials are supplied by Oswald Decorating, these will be itemised within the quotation or invoice.

  1. TIMESCALES

We will always endeavour to complete work within the timescale agreed at the outset. Timescales may be subject to change due to factors outside our control, including adverse weather conditions, delays in material supply, or unforeseen issues identified during the course of work. We will communicate any delays promptly and agree a revised schedule with you.

  1. COMPLETION & SNAGGING

Upon completion of work, we ask that the client inspects the finished result and raises any concerns before we leave site where possible. Any snagging items identified within 7 days of completion will be addressed at no additional charge, provided they relate to the original scope of work. Concerns raised after this period may be subject to an additional charge.

  1. CANCELLATION

Should you wish to cancel or postpone agreed work, please give us as much notice as possible. Cancellations made with less than 48 hours notice may result in a cancellation charge to cover any materials purchased or time allocated. Any deposit paid is non-refundable in the event of cancellation by the client unless otherwise agreed.

  1. LIABILITY

Oswald Decorating carries public liability insurance. We are not liable for any loss or damage that is beyond our reasonable control, including pre-existing damage to surfaces, structures, or materials. We are not responsible for any indirect or consequential loss arising from the work carried out.

  1. DISPUTES

In the unlikely event of a dispute, we ask that you contact us in the first instance to discuss the matter. We will always endeavour to resolve any issues fairly and promptly. If a resolution cannot be reached, disputes may be referred to an appropriate alternative dispute resolution service.

  1. GOVERNING LAW

These terms and conditions are governed by the laws of Scotland. Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.
